Please read these Terms of Service ("Terms") carefully before using caratly.com.au (the "Site") operated by Caratly ("us", "we", or "our"). By accessing or using the Site, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing and using this Site, you accept and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our Site.
2. Products and Pricing
We reserve the right to modify prices, discontinue products, and correct errors at any time without notice. All prices are displayed in Australian Dollars (AUD) and include GST unless otherwise stated. We are not responsible for typographical errors in pricing.
Product images are representative only. Due to the nature of individually crafted jewellery and the unique characteristics of each lab-grown diamond, slight variations in appearance may occur.
3. Orders and Payment
By placing an order, you represent that:
- You are at least 18 years of age
- The information you provide is accurate and complete
- You are authorised to use the payment method provided
We reserve the right to refuse or cancel any order at our discretion, including but not limited to cases of suspected fraud, pricing errors, or stock unavailability. If your order is cancelled after payment, you will receive a full refund.
4. Shipping and Delivery
We offer free insured shipping on all orders within Australia. Estimated delivery is 5–7 business days for in-stock items. Custom orders may take 3–5 weeks. We are not responsible for delays caused by couriers, customs, or events outside our control.
Risk of loss and title for items pass to you upon delivery to the carrier. We provide tracking information for all shipments.
5. Returns and Refunds
We offer a 30-day return policy on all jewellery in original, unworn condition with tags attached. Custom, engraved, or resized items are not eligible for return unless defective.
To initiate a return:
- Contact us at returns@caratly.com.au within 30 days of delivery
- Receive a Return Authorisation Number (RAN)
- Return the item in original packaging via tracked, insured post
- Receive a full refund to your original payment method within 5–10 business days of receipt
Return shipping costs are at the customer's expense unless the return is due to a defect or our error.
6. Warranty
All Caratly jewellery comes with a lifetime manufacturing warranty covering:
- Diamond loss due to defective setting (assessed on a case-by-case basis)
- Manufacturing defects in the metal setting
- Prong failure or structural issues under normal wear
The warranty does not cover normal wear and tear, accidental damage, loss, theft, or damage resulting from improper care.
7. IGI Certification
All diamonds sold by Caratly are accompanied by an International Gemological Institute (IGI) certificate. The certificate is the property of the customer and must be retained for insurance, resale, and warranty purposes.
8. Intellectual Property
All content on this Site — including text, images, logos, product designs, and software — is the property of Caratly or its content suppliers and is protected by Australian and international copyright laws. You may not reproduce, distribute, or create derivative works without our express written permission.
9. User Accounts
If you create an account on our Site, you are responsible for maintaining the confidentiality of your password and for all activities under your account. You agree to notify us immediately of any unauthorised use of your account.
10. Limitation of Liability
To the fullest extent permitted by law, Caratly shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or our products. Our total liability to you for any claim arising from a product purchase shall not exceed the purchase price of that product.
Nothing in these Terms limits any rights you have under the Australian Consumer Law.
11. Australian Consumer Law
Our products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
12. Governing Law
These Terms are governed by the laws of Queensland, Australia. You agree to submit to the exclusive jurisdiction of the courts of Queensland for any disputes arising under these Terms.
13. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Your continued use of the Site after changes constitutes acceptance of the updated Terms.
